Updated March 15, 2024
You are using this App either because you are a driver (“Driver”) making deliveries to an end-user (“EU”) on behalf of a customer (“Customer”) of DispatchTrack LLC or its affiliated entities or their successors (“DT”) or because you are an EU who is receiving a delivery (“Delivery”) which you wish to track.
This Privacy Policy describes DT’s policies and procedures on the collection, use, and disclosure of your information when you use this App in connection with one or more Deliveries and tells you about your privacy rights and how the law protects you.
The personally identifiable data (“Data”) that you may upload and/or that the App may otherwise collect or receive may include:
- For the Driver: name, photograph, driver’s license, vehicle registration, telephone number, email address, and vehicle location.
- For the EU, the EU’s name, address, email address and phone number.
In addition, as to the Delivery, Data that you may upload and/or that the App may otherwise receive may include the bill of lading, invoice, and/or customer receipt for the Delivery and photographs showing the goods being delivered and their placement at the Delivery location, which may or may not include Data. For the Driver, we may track usage data, such as when you used the App and the amount of time you spent using the App. If you do not want your location to be tracked, you may use restriction capabilities built into the App so that GPS information is never shared with the App.
In no event will the Data include any credit or debit card or bank account information.
While DT stores the Data at the Customer’s request, the Data belong to the Customer who has the ability to modify or delete them. DT will take reasonably necessary actions to ensure that Data that DT stores is treated securely and in accordance with this Privacy Policy and no transfer of Data will take place other than as described in this Privacy Policy. You have the right to delete or request that Customer delete the Data that DT has received and stored. If you request that any of the Data be modified or deleted, please make such request to the Customer. Should you make them to DT, DT will pass your request onto the Customer for action. You may make a request to DT by email at support@dispatchtrack.com.
The Customer will have its own policies as to how long it wishes DT to retain the Data and how long the Customer may retain the Data and how the Customer uses the Data if the Customer downloads the Data from DT. If the relationship between DT and the Customer is terminated, DT will typically after 30 days delete the Data for that Customer.
The App does not allow the EU to see information regarding the Driver beside the Driver’s name, photograph, and vehicle location. The App does not provide any Data regarding the EU to the Driver besides Data that the Driver already had received from the Customer.
Besides use in providing services to the Customer related to the Delivery, DT’s sole use of the Data will be for research and development and to improve its services to the Customer and other customers. Any such non-Delivery use will be in an aggregated and/or anonymous manner so that no personal data will result from such usage. Other than to the EU and Driver as described above, DT will not share the Data with any person other than the Customer, except under extraordinary circumstances described below. DT will not use the Data to contact you except that the Driver may be contacted by Customer or the warehouse via the App.
DT stores the Data on its computers located at DT facilities throughout the world. DT has no control over what the Customer does with any Data that the Customer downloads and disclaims any responsibility for any action or failure to act by the Customer in these regards. You or your employer are responsible for whatever relationship exists with the Customer.
DT attempts not to store or collect personal information owned by persons under 18 years of age. If you are a parent or guardian and you are aware that your child has provided Us with Data, please contact Us. If DT becomes aware that it has collected Data from anyone under the age of 18 DT will take steps to delete that Data. DT reserves the right to unilaterally eliminate Data that does not comply with its Terms and Conditions or Privacy Policy.
DT may disclose Data under extraordinary circumstances such as if required to do so by law or in response to valid requests by public authorities such as a court or government agency or in the good faith belief that such action is necessary to comply with a legal obligation or to protect the personal safety of the EU or Driver or the public.
